A. Basis for Setting up the China Interim Authority
a. The China Interim Authority has established the following two fundamental political missions:
(1) Take people’s activities of safeguarding fundamental human rights and resisting the tyranny as the main body; unite people of lofty ideals who pursue freedom and democracy from inside the CCP and the government and military, to ultimately form social and political activities for the people’s comprehensive resistance; adopt all possible means that modern human rationality and conscience allows and thoroughly annihilate the Chinese bureaucracy's totalitarian autocratic politics, and clear away political obstacles for the creation of a Federal China of constitutional democracy.
(2). Create a system of constitutional democracy, according to the principle that “sovereignty belongs to the people,” the modern legal spirit and theories of separation, checks and balances of power; create a Chinese Federation, according to the spirit of autonomy and republic of ethnicities and regions.
b. The ultimate political pursuit of the China Interim Authority is to establish a federal China characterized by freedom, democracy, human rights, and nomocracy. The Authority shall set up institutions and agencies according to the practical needs in fulfilling the aforementioned fundamental political missions.
c. The China Interim Authority will be automatically dismissed after the mission of thoroughly annihilating the totalitarian rule of the CCP’s bureaucratic group is completed and the democratic regulation of achieving people’s political selection right is established through an open, fair, and free election in the form of national referendum, so that the principle of returning governance and rights to Chinese people can be achieved ; the governor of the authority of future democratic China shall be determined by open, fair, and free elections, and the people’s political selection right shall serve as the legitimate foundation for any person or political party to be in charge of state power.
B. The Composition of the China Interim Authority
1. The China Interim Authority is composed of the China State Policies and Power Supervision Conference and the China Interim Government.
2. The China State Polices and Power Supervision Conference has one parliamentary president and one vice parliamentary president.
The first-term parliamentary president and vice parliamentary president were elected by the Steering Committee of the China Interim Government. The second-term parliamentary president and vice parliamentary president will be elected by the China State Policies and Power Supervision Conference.
The parliamentary president and vice parliamentary president shall serve a one-year tenure and are eligible for reelection and reappointment, but neither shall serve for more than two tenures.
Parliamentary members shall serve one-year tenure and are eligible for reelections and reappointments.
3. The China Interim Government has one president and one vice president.
The first-term president and vice president were elected by the Steering Committee of the China Interim Government. The second-term president and vice president shall be elected by the China State Polices and Power Supervision Conference
The president and vice president shall serve one-year tenure and are eligible for reelection and reappointment, but neither can serve for more than two tenures.
4. The election procedures of the parliamentary president, vice parliamentary president, and parliamentary members of the China State Polices and Power Supervision Conferences shall be stipulated in a separate set of regulations set up by the Conference.
The election procedures of the president and vice president of the China Interim Government shall be stipulated in a separate set of regulations set up by the China State Polices and Power Supervision Conference.
C. The China State Policies and Power Supervision Conference
1. The Functions of the China State Policies and Power Supervision Conference
(1) Establish the principal political schemes and laws of safeguarding basic human rights, disintegrating the CCP’s tyranny, and creating constitutional democracy, and present such schemes and laws to the China Interim Government for implementation.
(2) Exert power supervision on the China Interim Government.
(3) Authorize the president of the China Interim Government to dismiss the interim government in time after the CCP tyranny is thoroughly annihilated and the constitutional democracy is established, and hold general elections based on the principle of returning governance and rights to the people.
2. Ways of exerting power supervision by the China State Policies and Power Supervision Conference
(1) Names of ministers of the China Interim Government appointed by the president shall be reported on file with the China State Policies and Power Supervision Conference; the Conference has the power to veto the president’s appointment of ministers if the majority of members vote approval.
(2) Demand the president, vice president, and ministers of each department to attend hearings for job report.
(3) Propose corrective opinions for the act of dereliction of duty committed by the president, vice president, and ministers.
(4) Demand the president to dismiss the ministers in dereliction of duty
(5) Propose impeachment case for the president or vice president.
3. The Composition of the China State Policies and Power Supervision Conference
The first session of the China State Policies and Power Supervision Conference is composed of the following members:
(1) Former members of the Steering Committee of the China Interim Government
(2) President and vice president
(3) Ministers of each department of the China Interim Government
(4) Individuals who have been approved to join the committee by the majority of Conference members.
(5) After its establishment, the China State Policies and Power Supervision Conference should, as one of its emphases, absorb individuals from all circles in mainland China into the Committee.
The election procedures of members of the second session of the China State Policies and Power Supervision Conference shall be stipulated in a separate set of regulations set up by the first session of the Conference.
4. The institutional setup of the China State Policies and Power Supervision Conference
The China State Policies and Power Supervision Conference shall set up professional committees according to actual needs. The following committees are the first to be established:
(1) The China Policies Design Committee
(2) The China Constitution Draft Committee
(3) The Committee of Policies and Strategies on China’s Rights Safeguarding and Tyranny Resistance
e. Rules of Procedure for the China State Policies and Power Supervision Conference
(1) Conference shall be convened and emceed by parliamentary president or a special committee designated by parliamentary president.
(2) In the absence of parliamentary president, vice president shall take over the responsibility.
(3) The detailed process of the rules of procedure shall be set up separately.
f. Special Note:
The detailed procedures to implementing the functions of the China’s State Policies and Power Supervision Conference shall be regulated in a separate set of rules set up by the conference.
D. The China Interim Government
a. The Basis for the Establishment of the China Interim Government
The two fundamental political missions aforementioned for the China Interim Authority form the basis of the establishment of the China Interim Government.
b. The Power Mechanisms of the China Interim Government
(1) Presidential responsibility mechanism is practiced. The president appoints and directly leads ministers of each department.
(2) When necessary, the president has the authority to form emergency departments to handle all kinds of sudden accidents in domestic China.
(3) The vice president assists the president in performing duties; in the absence of the president, the vice president shall take over the president’s duties.
(4) The China Interim Government is supervised by the China State Policies and Power Supervision Conference.
3. The Detailed Setup of Ministries of the China Interim Government
(1) The Planning and Steering Ministry of the Democratic Regime Establishment
Main functions: Set up the detailed implementation schemes of the democratic regime establishment and the detailed process of national referendum and election based on widely soliciting opinions from all circles of personnel so that the returning of governance to people is practiced in time after annihilating the CCP tyranny.
(2) The Ministry of Financial Affairs
Main functions: Raise funds for the fulfillment of the fundamental political missions and manage the government operating expenses.
(3) The Ministry of Foreign Affairs
Main functions: Responsible for the Interim Government’s foreign affairs on the basis of the needs to thoroughly annihilating the CCP tyranny and creating a constitutional democracy.
(4) The Ministry of Investigation on National Land Resources and State Enterprises
Main functions: Comprehensively investigate the national land resources; prepare the legal draft of 《Citizen’s Individual Land Privatization》; arrange to hold a referendum on the legal draft of 《Citizen’s Individual Land Privatization》after the CCP tyranny is annihilated; and return the ownership of the land to people in the way of nomocracy; Comprehensively investigate the assets of state enterprises controlled by the CCP tyranny, and fully prepare the implementation of the state policy for returning assets to the people after the collapse of the CCP tyranny. Establish the special investigation on the cases that the CCP’s malfeasants, colluded with profiteers, privately carve up the assets of former state enterprises in the name of economic reform; every case should be put on record and investigated in order to make the evidence and legal preparations for the retrieval of the assets of former state enterprise and return of the assets to the employees of former state enterprise.
(5) The Ministry of Investigation on the CCP Tyranny’s Crimes against Humanity
Main functions: Comprehensively investigate all the crimes against humanity committed by the CCP since it came into power and the affiliated organizations and officials involved in the cases, in order to make legal preparations for the persecution of the CCP tyranny and officials involved in related international courts or independent special courts established in the future democratic China.
(6) The Ministry of Information
Main functions: Responsible for information publication for the China Interim Government
(7) The Ministry of Psychological Warfare
Main functions: Effectively propagandize the China Interim Government’s political concepts, principles and strategies, and schemes of social reform; inspirit the confidence and volition of the people of all classes in China to safeguard basic human rights and resist tyranny, and disintegrate the political will of the CCP tyranny and its officials.
(8) The Headquarter of Command on the Rights Safeguarding and Tyranny Resistance
Main functions: Provide reinforcement on guidance of policies and schemes, funds, information, and provide unified and coordinate mechanism for the activities on safeguarding basic human rights and resisting tyranny performed by the farmers, state enterprise laid-off workers, peasant workers, demobilized soldiers, college students, and etc; launch historically social movement of national resistance against the CCP tyranny at opportune moment, and initiate a decisive political war against the CCP tyranny utilizing all means permitted by human rationality and conscience.
(9) The Ministry of Work on Military Forces
Main functions: Take effective measures to facilitate the transition from the military forces controlled by the CCP bureaucratic group to the National Defense Forces belonging to the future federal China; and make comprehensive preparations for annihilating the CCP tyranny through military means.
(10) The Ministry of Rectification on Injusticed, False, and Improper Legal Cases
Main functions: Accept appeals and accusations from people who have been unjustly, falsely, or improperly charged or sentenced under the CCP tyranny; make preparations for clearing the injusticed cases created by the CCP tyranny; and draft implementation schemes to confiscate the “party assets” snatched from the people by the CCP tyranny and the personal assets of malfeasants who are convicted of criminal acts, and to compensate the victims impacted by injusticed, false, and improper cases.
(11) The Ministry of Social Work
Main functions: Form a national alliance to resist tyranny and establish democracy by widely rallying farmers, laid-off workers, peasant workers, entrepreneurs and businessmen, intellectuals, college students, demobilized soldiers, officials from the internal CCP, and etc in order to fulfill the fundamental political mission of totally annihilating the CCP tyranny.
(12) The Ministry of Work on Political Parties and Civil Groups
Main functions: Assist and coordinate people from all circles to form various civil organizations, political parties, and community groups in order to achieve the right of freedom of association for the Chinese citizens; and establish nationwide autonomous associations that are independent of the CCP tyranny, including trade unions, farmers associations, business federations, comrade-in-arms unions of veterans, student unions, and so on.
E. Effective Date, Revision, and Termination of the Charter
1. The Charter becomes effective on its publication date of January 1, 2008.
2. The Charter can be revised with the approval by two thirds of the members of the China State Policies and Power Supervision Congress, if one third of the members jointly sign and launch the proposal or the parliamentary president does so.
3. The Charter can be terminated with the approval by two thirds of the members of the China State Policies and Power Supervision Conference, if one third of the members jointly sign and launch the proposal or the parliamentary president does so.
